EXPORT COMPLIANCE

United States Export Regulation Compliance

The Export Compliance Policy of Infinity Air, Inc. requires verification of the end use and end user of all products and all technical data transfer and software to ensure compliance with all applicable U.S. Export Laws and Regulations. Due to this policy, we ask that you confirm the following:

1. I (WE) AGREE that I (we) will not export or re-export any products, technology or software to embargoed/sanctioned countries including, but not limited to, BALKANS, BELARUS, BURMA (MYANMAR), COTE D’IVOIRE, CRIMEA REGION OF UKRAINE, CUBA, DEMOCRATIC REPUBLIC OF CONGO, DONETSK PEOPLE’S REPUBLIC (DNR), IRAN, IRAQ, LIBYA, LUHANSK PEOPLE’S REPUBLIC (LNR), MOLDOVA, NORTH KOREA, RUSSIA, SOMALIA, SUDAN, SYRIA, UKRAINE, VENEZUELA, and ZIMBABWE, and any other country to which shipment is prohibited, unless otherwise expressly authorized by the United States. Buyer accepts all responsibility for any export of these commodities to comply with all US Exports Laws and Regulations.

2. I (WE) AGREE that I (we) will not sell, transfer, export or re-export any of these products for use in activities which involve the development, production, use or stockpiling of nuclear, chemical or biological weapons or missiles, nor use these products in any facilities which are engaged in activities related to such weapons.

3. I (WE) AGREE that I (we) acknowledge U.S. export laws and regulations prohibiting the sale, transfer, export or re-export or other participation in any sale or export transaction involving our products with individuals or companies listed in the U.S. Commerce Departments Table of Denial Orders, Entity List, Unverified List, the U.S. Treasury Department List of Specially Designed Nationals (SDNs) and Specially Designated Terrorists (SDTs) and the U.S. Department of State’s Debarred List.

4. I (WE) AGREE that I (we) will abide by such U.S. export laws and regulations for any products purchased from Infinity Air Group and will obtain any licenses or prior approvals required by the U.S. Government prior to re-export of U.S. supplied products, software or technology.

5. I (WE) AGREE that I (we) acknowledge that Infinity Air Group is subject, as applicable, to the provisions of the U.S. Export Administration Regulations (EAR), the U.S. International Traffic in Arms Regulations (ITAR), the Arms Export Control Act (AECA) and the programs administered by the U.S. Office of Foreign Assets Control (OFAC). I (we) agree not to act in any transaction with Infinity Air Group in any manner that would place Infinity Air Group in violation of U.S. export laws or regulations.

6. I (WE) AGREE that I (we) warrant that the products are being purchased for use on commercial aircraft for civil commercial uses and not for operations permitting the aircraft to fly to any restricted country or for transfer to, or transfer of possession of or operational control to any restricted country.

7. I (WE) AGREE that the requirements in Numbers 1-6 above shall survive the completion, early termination, cancellation or expiration of any purchase order, agreement or contract with Infinity Air Group.

8. I (WE) AGREE that should I (we) become aware of any violation or suspected violation of the terms of this certification, I (we) will immediately notify Infinity Air Group of the facts and circumstances and will fully cooperate with any investigation.

9. I (WE) AGREE that this certification applies to the company listed below and include all subsidiaries and affiliated companies.

10. I (WE) AGREE that confirmation of the above will not expire unless expressly rescinded in writing to Infinity Air Group.
